1. Acceptance of These Terms

These Terms of Service (“Terms”) govern your access to and use of the Vivixo website, web app, progressive web app (PWA), blog, and related services (collectively, the “Service”). By accessing or using the Service, you agree to these Terms and our Privacy Policy.

If you do not agree, do not use the Service.

2. Who We Are

3. Eligibility (Adults Only)

The Service is intended only for adults. You must be 18 years or older (or the age of majority where you live, if higher) to use the Service. We do not knowingly allow minors to use the Service. If we learn that a user is underage, we may suspend or terminate the account and take appropriate steps under applicable law. (Federal Trade Commission)

4. Account Registration and Security

You may need an account to access some features (including VIP benefits). You agree to:

• Provide accurate information and keep it updated.
• Maintain the confidentiality of your login credentials.
• Notify us promptly of any unauthorized access or suspected breach.

You are responsible for all activity under your account.

5. Service Overview

Vivixo helps users discover and interact with hosts/creators (“Hosts”) through features that may include:

• Browsing and searching Hosts.
• 1-on-1 communication features.
• Virtual items/currency (e.g., coins) used for certain interactions.
• VIP subscription benefits.

We may update, modify, suspend, or discontinue any part of the Service at any time.

6. Virtual Currency, Virtual Items, and Pricing

Coins / Virtual Currency

• Coins and similar virtual items are not legal tender, have no cash value, and are not redeemable for money unless required by law.
• Coin pricing, bundles, and feature requirements may change.
• Coins may be subject to expiration, account restrictions, fraud checks, and limits.

Non-Refundable Nature

Except where required by law, all purchases of coins, virtual items, and VIP are final and non-refundable once delivered or made available.

7. VIP Subscription (e.g., $9.99/month + bonus coins)

If you purchase VIP:

• VIP provides access to certain features and benefits (which may include advanced filters/search, discounts, priority access, bonuses, etc.).
• Subscription price, bonuses, and included benefits will be shown at checkout and may change prospectively.

Auto-Renewal and Cancellation

Unless stated otherwise at purchase:

• VIP subscriptions auto-renew until you cancel.
• You can cancel anytime through the method provided at purchase (e.g., account settings or platform billing portal). Cancellation takes effect at the end of the current billing period.

Trials and Promotions

If a trial or promotional period is offered, the terms will be disclosed at sign-up.

8. Community Standards and Prohibited Conduct

Vivixo is designed to be safe and respectful. You agree not to:

• Use the Service if you are under 18.
• Harass, threaten, extort, stalk, or bully others.
• Share content that is illegal, exploitative, or non-consensual.
• Share content involving minors or any content that suggests minors are involved.
• Impersonate others or misrepresent your identity.
• Engage in fraud, chargebacks abuse, or payment manipulation.
• Attempt to bypass paywalls, security, or access controls.
• Scrape, harvest, or collect data from the Service without permission.
• Upload malware, attempt to disrupt systems, or reverse engineer the Service (except to the extent permitted by law).

We may remove content, restrict features, suspend, or terminate accounts for violations.

9. Safety Tools, Reporting, and Enforcement

We may provide tools such as report, block, or mute. Use these tools when needed. We may review reports and take enforcement action, including warnings, suspensions, or removals, to protect users and comply with law.

10. User Content and Permissions

You may be able to submit content (messages, profile details, images, etc.) (“User Content”).

• You retain ownership of your User Content.
• You grant Vivixo a worldwide, non-exclusive, royalty-free license to host, store, display, and distribute User Content solely to operate and improve the Service, enforce these Terms, and comply with legal obligations.

You are responsible for your User Content and for ensuring you have all rights needed to share it.

11. Host Content and Availability

Hosts are independent users or partners. We do not guarantee:

• Availability, responsiveness, or quality of any Host interaction.
• That any Host will match your preferences or be online at any time.

We may remove Hosts, reorder listings, or adjust discovery logic at our discretion.

12. Intellectual Property

The Service, including software, design, logos, and content provided by Vivixo, is owned by Vivixo or its licensors and is protected by applicable laws. You may not use our trademarks or content without permission.

13. Third-Party Services

The Service may integrate third-party services (payments, analytics, advertising). Your use of third-party services may be governed by their terms.

14. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE OPERATION.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIVIXO WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID TO VIVIXO IN THE PAST 3 MONTHS (OR $100 IF YOU PAID NOTHING), UNLESS REQUIRED OTHERWISE BY LAW.

16. Indemnification

You agree to indemnify and hold Vivixo harmless from claims arising out of your use of the Service, your User Content, or your violation of these Terms.

17. Dispute Resolution (Optional - Confirm with Counsel)

Important: The following arbitration/class action waiver language should be reviewed by your attorney to match your business and jurisdiction.

• Informal resolution first (contact support).
• If unresolved, disputes may be resolved through binding arbitration on an individual basis (no class actions), except where prohibited by law.

18. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice (e.g., via the Service). Continued use after changes means you accept the updated Terms.
